Occupational health practioners
The examination of the physical fitness for unaffiliated driving and operating of traction units is carried out by occupational health practitioners and occupational health centres, respectively.
In processing an application, we examine the documents (expert opinions) to be attached to it pursuant to § 131 lit 3 EisbG on the basis of the following criteria:
- Was the person examined the one referred to in the documents (name, address and date of birth)?
- Has the expert opinion been prepared by an occupational health practitioner or an occupational health centre authorized for examining the physical fitness for unaffiliated driving and operating of traction units?
- Does the expert opinion confirm compliance with the statutory minimum requirements?
The minimum requirements confirmed in the respective expert opinion are determined by Community law and result from Annex II of Directive 2007/59/EC dated 23.10.2007. For § 132 EisbG, the respective sections 1.1, 1.2, 1.3 and 2.1 define the minimum requirements.

The expert opinion must carry the following heading:
“Expert opinion pursuant to § 131 Z 3 in connection with § 132 EisbG”
The expert opinion must contain the following information:
“II confirm that in issuing the expert opinion I took into account to a sufficient extent the provisions contained in § 132 EisbG and consequently the requirements specified in Annex II of Directive 2007/59/EC dated 23.10.2007 and that I carried out the check-ups specified there. The person examined complies with the requirements stipulated there.”
